| 1. Preamble and Commitment

SNXT INFRASTRUCTURES (hereinafter "SolarNext" or "We"), concerned with the rights of individuals, particularly regarding automated processing and transparency with its users, has implemented this policy to define how we collect, use, and protect your data. We strictly comply with the General Data Protection Regulation (GDPR) No. 2016/679 and the amended Data Protection Act.

| 2. Data Collected

As part of the use of our platform and services, we collect the following categories of data:

Identity Data (KYC/KYB)Name, surname, company name, Kbis (registration), ID (for producers and investors, in compliance with anti-money laundering regulations).
Contact DataEmail address, phone number, postal address of the headquarters or production site.
Energy Data (IoT)Load curves, solar production index (kWh), consumption index, delivery point (PDL/PRM), data from grid operators (e.g., Enedis).
Technical & Blockchain DataIP address, connection logs, and Public Digital Wallet Addresses (0x...).

| 3. Purposes of Processing

We process your data for the following reasons:

  • Contractual execution: Providing access to the SaaS platform, auditing solar production, generating CSR reports.
  • Legal Obligation: KYC (Know Your Customer) compliance and fight against tax fraud or money laundering (AML-CFT).
  • Blockchain Service: Issuance of digital proofs (tokens) representing energy assets or usage rights.

| 4. SPECIAL CLAUSE: BLOCKCHAIN AND IMMUTABILITY

Blockchain Protocol Warning
Important warning to the user: Our technical architecture relies on distributed ledger technologies (Blockchain). The user is informed that:
  • Their Public Key (Wallet Address) is considered pseudonymous data (indirect personal data).
  • When a transaction is executed on a public (e.g., Polygon, Ethereum) or permissioned blockchain, the recorded data (sender address, recipient address, timestamp, amount/quantity of energy) becomes technically unerasable and immutable.

By using our Web3 services, the user expressly consents to the data strictly necessary for the operation of the "Smart Contract" being permanently recorded on the blockchain.

Impact RGPD :Consequence on the Right to be Forgotten: The right to erasure (Art. 17 GDPR) can only apply to data stored on our centralized servers ("Off-chain" SQL databases). It cannot technically apply to data anchored on the blockchain ("On-chain").

| 5. Data Recipients

Your data is transmitted exclusively to the following recipients:

  • Internal: Authorized SNXT INFRASTRUCTURES personnel.
  • Technical Subcontractors: Hosts (e.g., AWS, OVH), identity verification providers, Smart Contract auditors.
  • Authorities: Energy grid operators (upon requisition or legal obligation) and administrative or judicial authorities if required by law.

| 6. Data Security

We implement technical and organizational measures (encryption, strict access management, firewalls) to protect your data. Regarding your private keys (access to your digital assets): SNXT INFRASTRUCTURES never stores your private keys (default "Non-Custodial" mode), unless explicitly stated otherwise in the context of a mandated custody service. You are solely responsible for the security of your wallet.

| 7. Retention Period

Active account dataRetained as long as the account is active.
Energy data5 years (commercial prescription).
Accounting/billing data10 years (legal obligation).
Blockchain dataUnlimited duration (by technological nature).

| 8. Your Rights (Data Protection)

In accordance with GDPR, you have the following rights regarding your "Off-chain" data:

  • Right of access and portability.
  • Right of rectification (if data is inaccurate).
  • Right to erasure ("Right to be Forgotten"), subject to Blockchain technical constraints (see Art. 4).
